Federal Court Issues Adverse Decision on Extended Producer Responsibility
On August 27, the Federal District Court for the District of Oregon issued a decision that the
Oregon Plastic Pollution and Recycling Modernization Act does not violate either the dormant Commerce Clause or the Due Process Clause of the United States Constitution. The regulation implementing this Recycling Modernization Act, known as Extended Producer Responsibility (EPR) has resulted in a very cumbersome and expensive regulation for food producers in Oregon.
